If you are just about to purchase a house of your dreams, probably the term “OC” has come up in discussions with developers, lawyers, and bank officials. It might seem like yet another piece of paperwork, but the Occupancy Certificate (OC) could be the most crucial document in the whole real estate transaction process.

The term ‘OC’ or ‘Occupancy Certificate’ in the real estate industry is a legal document that is granted by the local municipal corporation or planning authority (for example, PMC in Pune or BMC in Mumbai). This certificate is an assurance that the construction of the property follows the approved plans and also meets all local laws and safety standards.

What is an Occupancy Certificate? 

In most cases, an occupancy certificate is like the “last piece of the puzzle.” It means that the house is fit for living. But, the government does not hand over the OC just like that; it does a very thorough check to make sure that the developer:

  • Built per the approved plans.
  • Implemented the fire safety measures.
  • Made arrangements for basic utilities like water and electricity.
  • Observed the norms for floor space index (FSI) and height violations.

What does OC mean in real estate? 

In simple terms, an OC in real estate determines whether a place is a “construction site” or a “legal residence.” A building is, without this certificate, basically an unauthorised one or “illegal” to live in, no matter how nice the interiors are.

It marks the end of the construction part. A developer can only build with the help of the Commencement Certificate (CC), and the buyer can only move in with the Occupancy Certificate (OC).

Why is OC important for homebuyers? 

Lots of buyers fall into the trap of taking possession and starting the interior work just because the building looks ‘ready’. Even so, you can’t really underestimate the significance of an OC for house buyers; in fact, you can say that it is indispensable. These are the main points for your reference:

  • Legitimate Occupation

Occupying property in the absence of an OC is an offence according to RERA. Until the concerned authority certifies your occupancy, you have no legitimate right to stay in the premises.

  • Availability of Utilities

In most urban areas, the municipality would not offer a permanent water supply or electrical connection if there is no OC for the apartment. Inhabitants living in buildings that lack an OC are usually forced to pay high charges for water tankers and temporary electricity.

  • Approval for Home Loan

The majority of banks and other financial institutions do not provide approval for the complete disbursement of the loan for buying a property without an OC. If at any point you plan on selling the property, it would become extremely difficult for the buyer to take a loan since there won’t be an OC, hence making your property worth less on the market.

  • Khata Certificate and Property Taxes

Many states do not issue you a Khata certificate (required for property tax calculation) without a proper Occupancy Certificate. You cannot officially pay property taxes if you don’t have a proper OC.

  • Eviction Notice

Without an Occupancy Certificate, the local municipal authority has every right to issue an eviction notice to the building or even cut off its water and electricity connections.

  • What does it mean if a developer does not have an occupancy certificate?

If the developer doesn’t give you an OC, they have likely changed the plan and not informed the authorities, or they have not paid the required fees to the local authority. It is better to get a lawyer’s opinion and also RERA intervention.

  • What is the possibility of applying for a Khata when you don’t have an OC?

In general, it is a no. Most of the local authorities will not issue a regular Khata without an OC. If you don’t have it, you may only get a ‘B-Khata’ (as in Bangalore), which indicates the property has irregularities.

  • Is OC only for apartments?

All permanent structures like independent houses, villas, and apartment complexes, including large ones, require obtaining an occupancy certificate.
